Q1. When must I submit my company's collective agreement (CA) to the Court for certification?

The signed CA must be submitted to the Court for certification within 7 days from the date of its signing.

Q2. How do I submit my company's collective agreement to the Court for certification?

You may submit the CA personally, through a representative or by post. The following must be submitted to the Court:

(a)  The original signed collective agreement (CA). Every page of the CA must be initialled by a representative of the company and the union.

(b)  You have also to pay a $20 registration fee, preferably by cheque, to be made payable to Registrar, Industrial Arbitration Court.

(c)  The softcopy of the new Collective Agreement in MS Word to be emailed to the Court at the following address:  mom_iac@mom.gov.sg before or not later than 3 days after the lodgment of the original printed signed copy.

Q3. Where is the IAC and what are its office hours?

The Court is located at Supreme Court of Singapore,
Level B1-44, 1 Supreme Court Lane, Singapore 178879
The Court is opened from 8.30 am to 6.00 pm from Mondays to Thursdays
and from 8.30 am to 5.30 pm on Fridays.
It is closed for lunch between 1.00 to 2.00 pm.
The Court is closed on Saturdays, Sundays and Public Holidays.

Q4. The union and my company would want to make some changes to certain clauses of our CA which is still in force. How do we go about it?

What you need to do would depend on how long your CA has been in force as indicated below:

(a) CA in force for less than 18 months

In this case, apply to the Court for variation of the CA by filling up the prescribed form (Form 6) and an affidavit. The draft Form 6 and affidavit should be sent via internet to mom_iac@mom.gov.sg for clearance before formal signing by the parties.

Once the Form 6 and affidavit are cleared by the Court, a date would be fixed for the representatives of the company and union to sign the documents in the presence of the Registrar or Asst Registrar.

On the day of signing, you are to bring along -

(i) 3 sets of Form 6 and affidavit;

(ii) a thumbdrive containing the proposed amendments to the CA in MS Word; and

(iii) a filing fee of $20.00, in cash or crossed cheque made payable to "Registrar, Industrial Arbitration Court".

(b) CA in force for 18 months or more

In this case, apply to the Court for variation of the CA by filling up the prescribed form (Form 6) only. No affidavit is required. The draft Form 6 should be sent via internet to mom_iac@mom.gov.sg for clearance before formal signing by the parties.

Once the form is cleared, you can proceed to get the representatives of the company and union to sign the form.

Then file the signed form with the Court as soon as possible. When filing, you have to submit -

(i) 1 set of Form 6;

(ii) a thumbdrive containing the proposed amendments to the CA in MS Word; and

(iii) a filing fee of $20.00, in cash or crossed cheque made payable to "Registrar, Industrial Arbitration Court".
